Please read these Terms of Service ("Terms") carefully before using the AuxForge website (auxforge.com) and the AI Agent Workbench service (the "Service") operated by AuxForge Inc. ("we", "us", or "our").

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

AuxForge provides an AI-powered software development workbench that orchestrates specialized agents (Terminal, API, Database, Code Editor, QA, etc.) to assist in building software features. The Service includes a desktop application, web interface, and supporting cloud infrastructure.

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account. You are responsible for safeguarding your password and for all activities under your account. You must notify us immediately of any unauthorized use.

4. Subscription Plans and Billing

• Free Tier (Hobby): Limited features at no charge. We reserve the right to modify free tier limits at any time.
• Paid Plans (Pro, Team): Billed monthly at the rates displayed on our pricing page. Prices are subject to change with 30 days' notice.
• Payment Processing: Payments are processed securely through Razorpay. By subscribing, you agree to Razorpay's terms of service.
• Auto-Renewal: Paid subscriptions automatically renew each billing cycle unless canceled before the renewal date.

5. Refund Policy

We offer refunds under the following conditions:

• If you cancel within 7 days of your initial subscription and have not extensively used the Service, you are eligible for a full refund.
• For billing errors or duplicate charges, contact us for an immediate correction.
• Refunds for partial billing periods are not provided unless required by applicable law.
• To request a refund, email us at admin@auxforge.com with your payment details.

6. Your Content and Data

• You retain all rights to the code, files, and content you create using the Service ("Your Content").
• You grant us a limited license to process Your Content solely to provide the Service (e.g., sending code context to AI models for agent functionality).
• We do not claim ownership of Your Content and will not use it to train AI models.
• You are solely responsible for the legality and appropriateness of Your Content.

7. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations.
• Generate, distribute, or facilitate malicious software, exploits, or cyberattacks.
• Attempt to reverse engineer, decompile, or extract the source code of the Service.
• Resell, sublicense, or commercially redistribute access to the Service without authorization.
• Abuse, overload, or interfere with the Service's infrastructure.

8. Intellectual Property

The Service and its original content (excluding Your Content), features, and functionality are and will remain the exclusive property of AuxForge Inc. and its licensors. Our trademarks, service marks, and logos may not be used without our prior written consent.

9. Service Availability

• We strive to maintain high availability but do not guarantee uninterrupted service.
• We may perform scheduled maintenance with reasonable advance notice.
• We are not liable for downtime caused by factors outside our reasonable control (e.g., third-party API outages, force majeure events).
• AI agent responses depend on third-party AI model providers and may vary in quality and availability.

10. Termination

• You may cancel your account at any time through the Service or by contacting us.
• We may terminate or suspend your account immediately, without prior notice, if you breach these Terms.
• Upon termination, your right to use the Service ceases immediately. We may retain Your Content for a reasonable period to allow you to export it, after which it will be deleted.

11. Limitation of Liability

To the maximum extent permitted by applicable law, AuxForge Inc., its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) the Service.
• Any errors, inaccuracies, or omissions in AI-generated code or content.
• Unauthorized access to or alteration of your data.
• Any third-party conduct on the Service.

12. Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. AI-generated code and suggestions are provided for assistance only and should be reviewed before use in production environments. We make no warranties, express or implied, regarding the accuracy, reliability, or completeness of AI outputs.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of Uttar Pradesh, India, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts in Jaunpur, Uttar Pradesh, India.

14. Changes to Terms

We may update these Terms from time to time. We will notify registered users of any material changes via email or in-app notification at least 15 days before they take effect. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
